Terms of Service
Adopted: October 1, 2026
These Terms of Service (“Terms”) govern the use of Putto AI (“Service”), provided by YGGSIL (合同会社YGGSIL, referred to as “we,” “us,” or “our”). Users (as defined in Section 2) must agree to these Terms before using the Service.
1. Scope
- These Terms apply to all aspects of the relationship between Users and us concerning the use of the Service.
- Any rules, guidelines, notices, or similar materials we publish on the Service or our website, regardless of what they are called, form part of these Terms.
2. Definitions
The following terms have the meanings set out below:
- User: An individual or legal entity that agrees to these Terms and uses the Service.
- User Content: Images, text (including prompts), and other information that a User uploads, enters, or sends to the Service.
- Output: Images and other results generated or edited by the Service using User Content or other inputs.
- Third-Party Services: Services provided by third parties that we use to provide the Service, such as Firebase and Google image generation APIs.
- Credits: Units representing the usage allowance required for image generation and other functions of the Service.
3. The Service
- The Service provides image generation and editing features, such as replacing backgrounds and generating product photography-style images, based on images and other materials uploaded by Users.
- The Service may be provided using Third-Party Services, such as Firebase Authentication and Google image generation APIs.
- We may change the specific features, specifications, and conditions under which the Service is provided at our discretion.
4. Registration and Accounts
- Use of the Service may require authentication through a method we specify, such as a Google account or an email address and password.
- Users are responsible for managing their account information and must not transfer, lend, or share it with third parties.
- We are not liable for losses suffered by a User due to unauthorized use of an account or similar circumstances, except where those losses result from our willful misconduct or gross negligence.
5. Credits
- Image generation and other uses of the Service may consume Credits.
- Image generation currently consumes 30 Credits per image. The displayed details for paid monthly plans are as follows:
- Starter: ¥3,200 / US$20 per month; 1,200 Credits per month (equivalent to 40 images)
- Pro: ¥7,200 / US$45 per month; 3,000 Credits per month (equivalent to 100 images)
- Max: ¥14,400 / US$90 per month; 6,900 Credits per month (equivalent to 230 images)
- Monthly plans renew on the day of the month corresponding to the subscription date. If that date does not occur in a given month, Stripe’s end-of-month adjustment applies. Monthly Credits are granted after payment is confirmed. Any unused Credits expire at the end of the applicable period and do not roll over to the next period. We do not currently sell additional Credits as one-time purchases. Details of the actual payment currency, taxes, handling of failed payments, refunds, and migration of existing balances will be published after legal and tax reviews and an assessment of the impact on existing users. This proposed revision remains subject to review before publication.
- Where necessary to operate the Service, we may change prices, the number of Credits granted or consumed, limits, expiration conditions, or similar terms on a prospective basis. We will announce any such changes in advance through an appropriate method.
- We may retain certain information after account deletion to prevent misuse. For details, please refer to the Privacy Policy.
6. User Content and Output
- By submitting User Content to the Service, Users warrant that they hold the necessary rights, including copyright, likeness rights, trademark rights, and other third-party rights, or have obtained valid permission to do so.
- When using Output, including publishing, selling, or using it commercially, Users must verify and warrant that the following conditions are met and are solely responsible for doing so:
- The Output does not infringe any third party’s copyright, likeness rights, trademark rights, or other intellectual property rights.
- Any person (model) depicted in the Output does not resemble a real person closely enough to be identifiable as that person at a glance, or cannot be mistaken for a real person.
- The Output does not infringe a real person’s likeness or publicity rights. These risks also apply where the Output is identifiable as a real person, even if that person’s name was not explicitly included in the prompt.
- The Output does not have both “dependency” on an existing copyrighted work (referencing or being based on that work) and “similarity” to it (essential similarity in expression).
- The Output does not imitate or reproduce a specific copyrighted work, other work, or character.
- Use of the Output does not violate laws, public order and morals, or third-party rights.
- If a User’s use of Output infringes third-party rights, the User is solely responsible for resolving the matter at their own expense and must not cause us any inconvenience or loss.
- We do not warrant Output’s fitness for a particular purpose, accuracy, completeness, lawfulness, or non-infringement of third-party rights.
- We may handle User Content and generation-related metadata, such as tags, aspect ratios, and generation methods, to operate and improve the Service, evaluate quality, prevent misuse, resolve technical issues, or for related purposes. For details, please refer to the Privacy Policy.
7. Prohibited Conduct
Users must not engage in the following conduct when using the Service:
- Violating laws or public order and morals
- Infringing third-party rights, including copyright, likeness rights, trademark rights, or privacy
- Infringing a real person’s likeness or publicity rights
- Publishing, selling, or commercially using Output that resembles a real person closely enough to be identifiable as that person at a glance, or that could be mistaken for a real person
- Intentionally trying to make an image resemble a real person, or generating or using an image that is identifiable as a real person, even if that person’s name is not explicitly included in the prompt
- Generating images to imitate or reproduce a specific copyrighted work, other work, or character
- Intentionally imitating existing copyrighted works, such as paintings, illustrations, photographs, or character designs
- Naming a specific author, work, or character in a prompt to generate images similar to an existing work
- Generating images with the intention of closely reproducing an existing work’s composition, design, expression, or similar features
- Facilitating copyright infringement
- Publishing, selling, or commercially using Output that may have both “dependency” on an existing copyrighted work (referencing or being based on that work) and “similarity” to it (essential similarity in expression)
- Gaining unauthorized access, reverse engineering, probing for vulnerabilities, or similar activities
- Violating the terms of Third-Party Services
- Placing an excessive load on the Service or our servers
- Interfering with the operation of the Service
- Engaging in conduct we consider inappropriate
8. Intellectual Property Rights
- Intellectual property rights in the Service’s software, designs, logos, text, and other materials, excluding User Content and Output, belong to us or other legitimate rights holders.
- These Terms do not transfer or license any intellectual property rights in the Service to Users, except for a non-exclusive license to the extent necessary to use the Service.
9. Disclaimers and Limitation of Liability
- We exercise reasonable care in providing the Service. However, we are not liable for interruptions, suspensions, malfunctions, data loss, defects in generated results, or similar issues, except where these result from our willful misconduct or gross negligence.
- Liability for Copyright Infringement and Other Infringement Involving Output
- We provide a platform for image generation and have no obligation to review or monitor Output in advance.
- If an image generated by a User infringes a third party’s copyright, likeness rights, trademark rights, or similar rights, the User is responsible. We accept no liability except in cases of our willful misconduct or gross negligence.
- We likewise accept no liability for losses arising from infringement of likeness or publicity rights where a person (model) depicted in Output resembles, or could be mistaken for, a real person. This also applies where the person’s name was not explicitly included in the prompt.
- We likewise accept no liability for losses arising from Output that resembles an existing copyrighted work or imitates a specific work.
- These exclusions do not apply where we are found to have engaged in willful misconduct or gross negligence. This includes, for example, cases where we knew of infringement and could have taken technically feasible preventive measures but failed to do so, or where we directly instructed or controlled the content of the Output.
- Disputes with Third Parties
- If a User’s use of Output gives rise to a dispute with a third party over copyright infringement or another matter, the User is solely responsible for resolving it at their own expense. We accept no liability for such disputes.
- If a third party makes an infringement claim against us, we may take measures such as deleting the Output concerned or suspending the User’s account.
- Even where we are liable for damages, our liability is limited to the amount the User paid us during the [●] months immediately preceding the date on which the loss occurred, or [●] yen if the Service was provided free of charge, except where this limitation is restricted by mandatory law.
10. Changes, Suspension, and Discontinuation of the Service
We may change, suspend, or discontinue the Service without prior notice.
11. Infringement Reports and Removal Procedures
- Submitting a Report
- If Output available on the Service infringes third-party rights, such as copyright, likeness rights, or trademark rights, the rights holder or their representative may submit a report through a method we specify.
- The report must include the rights holder’s name and contact details, the facts of the infringement, details of the rights infringed, information identifying the Output concerned, and other relevant information.
- Investigation and Response
- We will investigate reports to a reasonable extent.
- If we consider infringement likely, we may, at our discretion, take measures such as deleting the Output concerned or suspending the User’s account.
- We will notify the person who submitted the report and the User concerned of the investigation’s findings and the measures taken.
- User Appeals
- A User whose Output has been deleted or who has been subject to another measure may appeal through a method we specify.
- If we receive an appeal, we will conduct a further investigation to a reasonable extent and notify the User of the outcome.
- Disclaimer
- We do not warrant the accuracy or completeness of the results of investigations or responses to reports.
- We are not liable for losses suffered by Users or third parties as a result of measures we take, except where those losses result from our willful misconduct or gross negligence.
12. Ending Use of the Service and Account Deletion
- Users may end their use of the Service through a method we specify.
- Data handling after account deletion is governed by the Privacy Policy.
13. Changes to These Terms
- We may change these Terms as necessary.
- Revised Terms take effect when we notify Users by posting them on the Service or through another method we consider appropriate.
